Claims Litigation Attorney

This position specializes in defending complex, high exposure trials and arbitrations with exposure in excess of policy limits, objective injury cases, and high profile fraud cases. This includes the defense of policyholders in complex litigated homeowners, personal injury and property damage lawsuits. The position also provides legal representation for the Exchange to defend and/or protect its interest in uninsured motorist claims, underinsured motorist claims, and other legal actions.

Responsibilities

  • Analyze cases, determine relevant facts, and develop legal theories and defense strategies.

  • Identify liability exposure for policyholders and the Exchange.

  • Manage complex, high‑exposure litigation with minimal supervision.

  • Develop and execute discovery plans, including written discovery, subpoenas, depositions, motions, and expert coordination.

  • Prepare for and defend trials, arbitrations, mediations, and all related court proceedings.

  • Prioritize and manage a heavy, complex caseload while meeting tight deadlines.

  • Communicate regularly with policyholders, claims representatives, and management regarding case status and developments.

  • Provide legal analysis on liability, damages, defenses, case value, and strategic recommendations.

  • Research and draft motions, trial briefs, appellate briefs, and legal opinions (including coverage issues).

  • Negotiate and settle cases; handle settlement collections.

  • Respond to attorney demand letters.

  • Participate in continuing legal education and provide training to attorneys and Claims staff.

  • Assist other attorneys and provide guidance to less experienced team members.

  • Maintain high ethical standards and strong client‑relationship skills.

Qualifications

  • JD Required

  • 7-9 years Insurance defense law Required

  • Thorough understanding of insurance contracts.

  • Must have superb command of trial techniques and strategies, and have exceptional evaluation abilities.

  • Thorough knowledge of trial procedures and the rules of the evidence.

  • Valid Driver's License, acceptable Department of Motor Vehicles record and minimum liability insurance

The starting pay range for this position is:

$145,900.00 - $194,600.00

Additionally, for full time positions, you will be eligible to participate in our incentive program based upon the achievement of organization, team and personal performance.
