Counsel II

GENERAL STATEMENT OF DUTIES AND RESPONSIBILITIESThe functions of the General Counsel’s Office at the Sex Offender Registry Board are to represent the Board at all administrative agency hearings, in state superior courts and appellate courts, and serve as in-house counsel. The Counsel II will be expected to perform a wide range of legal functions which require extensive writing and oral advocacy experience.

Detailed Duties:

• Represent the Board in all aspects of the classification hearing process through disposition, as described under the sex offender registry laws.
• Prepare and present evidence for administrative law hearings before a hearing officer or the Sex Offender Registry Board regarding classification
• of sex offenders.
• Responsible for tracking through final disposition all cases assigned.
• Represent the Board in all aspects of state superior court and appellate court proceedings.
• Provide the administration with written legal advisory opinions.
• Review and provide written analysis of current legislation.
• Conduct extensive research and prepare proposed legislative and regulatory language.
• Respond to inquiries from attorneys and members of the public regarding the sex offender registry law.
• Develop materials and present training on a broad range of topics.
• Assist the General Counsel and Deputy General Counsel with any special projects or legal needs as directed.
• Litigation duties include travel to state and federal courts located throughout the Commonwealth. A valid driver’s license is needed to travel to/from the courts, not all of which are located near public transportation.

QUALIFICATIONS REQUIRED AT HIRE (List knowledges, skills, abilities)

• Have a current license to practice law in Massachusetts and be in good standing with the Board of Bar Overseers.
• Have a minimum of 2 years of superior court experience.
• Possess superior research, analytical and writing skills or a minimum of 2 years of appellate court experience; Working knowledge of criminal justice system.

• Demonstrate an ability to handle a fast-paced litigation environment.

• Ability to draft and review proposed legislation and regulations and to analyze and report the effect of proposed legislation.

• Experience in developing and providing educational programs and training.

QUALIFICATIONS ACQUIRED ON JOB (List knowledge, skills, abilities) –

• Knowledge of enabling statute and companion regulations.

MINIMUM ENTRANCE REQUIRMENTSApplicants must have a Juris Doctor (JD) degree, admission to the Massachusetts Bar and (A) at least three years of full-time, or equivalent part-time, professional experience in the practice of law.Incumbents may be required to have a current and valid Motor Vehicle Driver’s License at a Class level specific to assignment.Substitutions: n/a
